Second Question of the Day December 31, 2013 Why do more state boards of pharmacy not issue cease and desist orders against compounding pharmacies who have had to recall compounded preparations?

The state Boards of Pharmacy often only take action AFTER THERE IS A COMPLAINT. They do not actively communicate with the FDA, other state boards of pharmacy, or even the court system (such as after a criminal conviction for felonies related to the practice of pharmacy). So, even though there is prima fascie evidence of violations, the cases NEVER MAKE IT TO THE BOARDS OF PHARMACY FOR DISCIPLINE, because no one is reporting the violation to the Department of Health.

Perhaps it is time for each state's Bureau of Enforcement to actively seek out violations and discipline the licensees, rather than to wait for dozens of people to die after an outbreak such as what happened with NECC?
