Old Forge Pharmacist Sentenced To 15 Months Imprisonment In Health Care Fraud Case

The United States Attorney's Office for the Middle District of Pennsylvania announced that an Old Forge pharmacist who previously plead guilty to health care fraud was sentenced on December 18, 2014 in federal court in Scranton. 
United States District Court Judge Malachy E. Mannion sentenced Peter J. Capitano, age 58, to 15 months imprisonment followed by a 3-year term of supervised release.  Capitano was also ordered to pay restitution in the amount of $166,287.03 to Blue Cross of Northeastern Pennsylvania and Medicaid.
According to United States Attorney Peter J. Smith, a criminal information was filed in January 2014 charging Capitano with engaging in a scheme to defraud Blue Cross of Northeastern Pennsylvania and Medicaid from 2007 through August 2013.  The scheme involved submitting claims or causing claims to be submitted to those health benefit providers for drugs allegedly prescribed when the prescriptions did not exist and for drugs not actually dispensed.
The charges stemmed from an investigation initiated in February of 2011 by the Federal Bureau of Investigation and the Department of Health and Human Services, Office of Inspector General.  
Assistant United States Attorney Michelle Olshefski prosecuted the case.

In 2013, state Health Director Michael Fine, in an unprecedented move, rejected a proposed settlement of the case ratified by the Board of Pharmacy and a hearing officer’s recommendation to suspend Leo Blais’ license for 2½ years.

Bauder's Pharmacy had reached a tentative deal in October with the Iowa Board of Pharmacy, under which the pharmacy could continue operating. That deal called for majority ownership to transfer from Mark Graziano to his sister, Bauder's pharmacist and co-owner Kim Robertson.

Owner and operator Paula Butterfield is charged in an information with making a false statement in a health care matter. Trivillian's is accused of dispensing compounded drugs and generic drugs and billing Medicare and Medicaid for brand name drugs, which are more expensive. Trivillian's also is accused of billing for drugs that weren't dispensed, and dispensing drugs outside a safe and clean environment.

Maryland Board of Pharmacy Delays Effective Day of its Regulations Governing Sterile Compounding Permit Programs


Important Sterile Compounding Information
 
The Maryland Board of Pharmacy voted to postpone the effective date of its regulations governing the Sterile Compounding Permit Program (COMAR 10.34.19 and 10.34.09) from Jan. 1, 2015, to July 1, 2015. As such, the Board will not accept applications for sterile compounding permits (or waivers thereof), nor enforcing permit requirements until July 1, barring any legislative changes. Notice of this postponement will be published in the Maryland Register as an Errata in the Dec. 26th publication.
