Great American Seeks To Limit Meningitis Outbreak Coverage

 

Law360, New York (April 15, 2014, 2:53 PM ET) -- Great American E&S Insurance Co. asked a Connecticut federal court on Monday for declaratory judgment that it is not obligated to indemnify contamination control supplier Liberty Industries Inc. for Liberty’s role in a 2012 meningitis outbreak that killed 64 people.

The insurance company said that though it has agreed to assume Liberty’s defense in a pending multidistrict litigation against it and the facility where the fungus outbreak occurred, exclusions in Liberty’s policy prevent it from being obligated to do so.
