Question of the Day November 10, 2013 What impact will the Drug Quality and Security Act of 2013 have on Medical Center Pharmacy v. Mukasey, 536 F.3d 383 (5th Cir. 2008), for those folks in Texas, Louisiana, and Mississippi?

Note this case is only applicable and binding to those federal courts over which the United States Court of Appeals for the Fifth Circuit  has appellate jurisdiction.  These federal courts include:

• Eastern District of Louisiana
• Middle District of Louisiana
• Western District of Louisiana
• Northern District of Mississippi
• Southern District of Mississippi
• Eastern District of Texas
• Northern District of Texas
• Southern District of Texas
• Western District of Texas

Also note that Congressional action can overturn caselaw.  In same cases you will have the clear intent of Congress and other cases you may not.
