Drug Quality and Security Act in public interest--It offers providers and patients better information about compounded drugs by directing FDA to make a list of FDA-regulated outsourcing facilities available on FDA’s website, requiring detailed labeling on compounded drugs, and prohibiting false and misleading advertising.

The words were chilling: Deadly medical scandal. Fungal meningitis. Contaminated steroids. Rare brain infection. The mold exserohilum rostratum.
In August 2012 people were getting sick and reporting common symptoms. Then people started dying — especially in Tennessee and Michigan. The cause was a mystery. The U.S. Centers for Disease Control and Prevention traced the outbreak to the New England Compounding Center in Massachusetts

Kudos to Oklahoma State Board of Pharmacy in OSBP v. Trinity Apothecary #99-6362 – Case No. 1222 for $15,000 fine

OSBP vs. Trinity Apothecary #99-6362 – Case No. 1222:

The Board was called to order by President Dudley to hear the case of Trinity Apothecary.

Tesh Patel, D.Ph. and owner of Trinity Apothecary was present and chose to appear without Counsel.

Chief Compliance Officer, Cindy Hamilton testified for the Board. Assistant Attorney General, Brinda

White prosecuted for the Board.

Ms. White presented the Board with the Complaint for review. The Respondent had been

charged with multiple violations of state and federal regulation and rules including shipping

prescriptions into the state without an Oklahoma license and without submitting those prescriptions that were CDS to the Oklahoma Prescription Monitoring Program (PMP). The Respondent has since obtained a non-resident pharmacy license in the State of Oklahoma.

Motion was made by Dr. Greg Adams and seconded by Dr. Dorothy Gourley that based on the clear and convincing evidence presented the Respondent be found guilty on all five (5) counts.

Motion passed on roll call vote.

Motion was made by Dr. Greg Adams and seconded by Dr. Dorothy Gourley that the

Respondent’s license be placed on probation for three (3) years until October 24, 2016. The

Respondent is ordered to pay a fine of $3,000.00 per count for a total of $15,000.00 which is due on November 15, 2013. The Respondent must immediately obtain a license from the Oklahoma Bureau of Narcotics and Dangerous Drugs (OBNDD) and send a copy of this license to the Board. The

Respondent is to do late reporting of filled scripts for CDS to the OBNDD PMP. Motion passed on roll call vote.

Facts about the Oklahoma State Board of Pharmacy

The Board is also responsible for the licensing and regulation of all pharmacies, medical gas suppliers, medical gas distributors and prescription drug wholesalers, packagers and manufacturers that do business in the State of Oklahoma.  The Board maintains approximately 16,328 registrant records.
The Board has the power and duty to inspect all places handling drugs, medicines, chemicals and poisons.  The Board is charged with the enforcement of federal and state controlled dangerous substance and prescription drug laws.  There are approximately 1,538 licensed outlets in the state which are inspected by the Board.
The Board investigates complaints concerning pharmacists, technicians and interns as well as pharmacies, medical gas suppliers and distributors, and prescription drug wholesalers, packagers and manufacturers.  The Board conducts hearings on all types of registrants and has the authority to reprimand, fine, suspend or revoke licenses and permits.  The Board also reviews and approves continuing education programs that pharmacists are required to complete in order to renew their license

Fourth Question of the Day December 1, 2013 How many cease and desist orders have been issued by states since the NECC outbreak? How many states have taken any enforcement action against any of the compounding pharmacies or pharmacists that the FDA found problems with?


Third Question of the Day December 1, 2013 How many compounding pharmacies blantantly advertise in a manner that shows criminal and civil activity such as fee spliting arrangements, etc.? What enforcement actions are state boards of pharmacy going to take to stop these actions? What actions are organizations that represent compounders going to take to help state boards of pharmacy to stop this illegal behavior?

Uh.... Didn't Supreme Medical Just run into issues with waiving of copays and sever ties to the compounding pharmacy they represented?
It won't be long until insurance companies figure out they are being billed huge sums of money for these creams and the compounding companies are pocketing a ton of money. Let's be real, how long until insurance companies put amstopmto this high priced practice?

They will just pay less. The payments are based on known generic quantities and concentrations. The higher the concentration and volume, the higher the price. Many insurance companies such as BCBS still reimburse, but instead of 120g and more at a time, they will only approve 30g or a weeks supply. There is nothing magical about the compounds or underhanded about the pharmacies (if they are billing appropriately). Happy hunting.

Just to set the story straight, Florida Board of Pharmacy requires or recommends strongly that all sales people are employees because of pharmacy compliance issues. Most legit companies are contracting their employee sales team. Commissions ranges are factored as salary not a per transaction basis. Figure up to 20-25%

FEI information on doping

The use of substances with the potential to affect equine performance, health or welfare and/or with a high potential for misuse are contrary to the integrity of equestrian sport and the welfare of the horses.
The FEI provides a list of substances prohibited for use in horses competing at FEI events – the FEI Equine Prohibited Substances List. This list consists of two groups of substances: banned and controlled medication. Banned substances are not permitted for use in horses competing. Controlled medications are acknowledged as substances with therapeutic veterinary benefits but are not permitted during FEI events because of the potential for their misuse.
Testing programmes and protocols are implemented to detect the presence of prohibited substances in horses competing. Urine and/or blood samples from horses tested are sent by courier to one of five FEI Laboratories.
Negative blood and urine analysis results within the programme are updated regularly on the website for Groups I and II only and can be accessed here.
Before giving any substance to a horse competing at FEI events, athletes and their support personnel should always check, if it is prohibited under the FEI Rules by using the FEI Prohibited Substances database. They should work with veterinary advisers to establish a safe withdrawal time before competing. Horses must never compete unless they are fit to do so. During events, the administration of treatments and supportive therapies must be authorised by the veterinary delegate or commission before administration, using the appropriate veterinary form. Anyone wondering why many people believe federal oversight is the only way horse racing can be effectively regulated — with uniform national standards regarding medication use, testing and enforcement — need look no further than comments made by Phil Hanrahan at last Thursday’s congressional subcommittee hearing on H.R. 2012, a bill better known as the Horse Racing Integrity and Safety Act of 2013.

VERY INTERESTING INFORMATION: Doping Problem In Horseracing Denied By Trainers

Thoroughbred racing’s drug problem was a myth, representatives of the horseracing industry recently told the U.S. Congress. Phil Hanrahan, the chief executive officer of the National Horsemen’s Benevolent and Protective Association, told Congress members that bringing in the United States Anti-Doping Agency to clean up the sport was addressing a problem that does not exist. However, a report by the California Horse Racing Board revealed that Bob Baffert, a Hall of Fame trainer, revealed on the same day that the trainer had been administering a thyroid hormone to every horse in his barn without ever checking to see if any of them had thyroid problems.
The California Horse Racing Board report revealed that thyroxine, the drug, was so routinely prescribed in the barn of Bob Baffert that it was dispensed for one of the horses a week after he had died. This report was made after an investigation was conducted by the California Horse Racing Board into the sudden deaths of seven horses trained by Baffert from 2011 to 2013. The report of the board found no evidence that California Horse Racing Board rules or regulations have been violated. In the meanwhile, Baffert declined to answer why he gave thyroxine to every horse in his barn if he did not know if the drug was required by the horses. The trainer wrote on Twitter, “I’m gratified that C.H.R.B. completed its investigation & found there was no wrongdoing.”
The report revealed that Baffert acknowledged directing his veterinarians to use the drug on all his horses. It was also disclosed that it was the trainer who asked his veterinarians to prescribe it, which is in conflict with the policy of the American Association of Equine Practitioners, the industry’s most influential veterinary group. According to the American Association of Equine Practitioners, treatments should be based upon a specific diagnosis and administered in the context of a valid and transparent owner-trainer-veterinarian relationship.
The investigators were told by Baffert that he believed the drug would help “build up” horses at his barn. The trainer remarked he stopped administering thyroxine to his horses after the seventh horse died last March. The CHRB report said thyroxine can cause “cardiac alterations” in horses according to one study. C.H.R.B.’s equine medical director, Dr. Rick Arthur, summarizing his report to the board that he had no conclusive explanation of how seven horses belonging to one trainer dropped dead during a period of sixteen months. He added that it is extremely abnormal statistically and went on to say that it does say there is something wrong here despite the fact that we couldn’t find anything.
In another development, three thoroughbred trainers (David Wells, Sam Webb, and Patricia Anne Rogers) were arrested and charged in federal court a day after a congressional hearing on doping in horse racing. The three trainers have accused of devising a scheme to defraud those betting on thoroughbred races at Penn National Race Course in Grantville by administering banned substances to horses within 24 hours of a race. If convicted, they face up to 20 years in prison and a $250,000 fine.

Massachusetts lawmakers must step up in the face of lax federal oversight to protect patients from contaminated drugs, which last year spawned a deadly fungal meningitis outbreak linked to a Framingham compounding pharmacy, according to a state legislator leading the charge for tougher laws.
“We went in with the understanding that we were going to be on a heavier hook than the feds,” said state Rep. Jeffrey Sanchez (D-Jamaica Plain), chairman of the Joint Committee on Public Health. “This just confirms it.”
President Obama signed a compounding pharmacy bill into law last week, but the federal legislation lacks any real oversight because it calls for large-scale compounding pharmacies to register on a voluntary basis with the FDA for inspections.
Tainted steroid injections from the now-shuttered New England Compounding Center have been blamed for the fungal meningitis outbreak that killed 64 people and infected 751 others in 20 states.
Sanchez, who soon will head into a conference committee to sort out differences between his House bill and a Senate version, said he has high hopes lawmakers will hammer out a deal to protect patients.
“When we come out with the bill I feel confident that we will be able to get at this so it doesn’t happen again. The problem with NECC was ... there was no reporting protocol,” Sanchez said. “If something happens like what happened with NECC and you get sick, you’ll be able to contact someone.”
State lawmakers also pumped more than $1 million into this year’s budget to hire more regulators for surprise inspections, 
Sanchez said.
The International Academy of Compounding Pharmacists released a statement saying the group does not believe a voluntary approach protects the public.
“IACP supports state efforts to strengthen oversight and inspection of compounding pharmacies,” the IACP said in the statement. “We also seek to ensure that states commit adequate resources to state oversight agencies, which the Massachusetts legislation does.”
Sanchez said he’s not feeling pressure from lobbyists to radically alter the legislation, which could come up for a vote in January.
“I think there is a general acceptance and understanding that change is coming relative to compounding pharmacies,” Sanchez said. “This bill was set up as one of the toughest in the country. We’ll come out with a model that can be used for the rest of the country.”
