Meningitis Lawsuit Update: NECC Supports Consolidation of Meningitis Lawsuits, Seeks Establishment of Federal Multidistrict Litigation in Massachusetts Bernstein Liebhard Continues to investigate meningitis lawsuits, as the number of fungal infections tied to NECC epidural steroid injections reaches 438, including 32 deaths from fungal meningitis.

The New England Compounding Center (NECC), the compounding pharmacy at the center of a multistate outbreak of fungal infections, is supporting the establishment of a multidistrict litigation for all federally-filed meningitis lawsuits pending against the company, Bernstein Liebhard LLP reports. In a November 7th brief submitted to the Judicial Panel on Multidistrict Litigation (JPML), NECC asserted that the cases would be more efficiently handled before a single federal judge in Massachusetts. According to the brief, NECC is currently named in 28 meningitis lawsuits, and expects additional personal injury and wrongful death claims to be filed against it in the future.
