A Kentucky woman who contracted fungal meningitis filed a federal lawsuit today — not against the pharmacy that made the medicine linked to the outbreak, but against its sister companies instead.
The lawsuit takes aim at what could be better monetary targets because the New England Compounding Center has filed forbankruptcy protection. The court papers also allege that a Nashville clinic used the Massachusetts-based pharmacy to save $2.45 a vial after its prior supplier increased the price of a steroid commonly used in spinal injections as a treatment for chronic pain.
William Leader, who represents Carolyn Bland and her husband, Leon Bland, of Cadiz, Ky., filed the lawsuit in the U.S. District Court for Middle Tennessee. Mrs. Bland spent a month in the hospital with fungal meningitis.
Leader points out common ownership and other links between the compounding pharmacy and five other companies, including Ameridose LLC, Medical Sales Management Inc., Medical Sales Management SW Inc., GDC Properties Management LLC and ARL Bio Pharma Inc.
Other defendants affiliated with the compounding pharmacy include Barry Cadden, Gregory Conigliaro, Lisa Cadden, Douglas Conigliaro, Carla Conigliaro and Glenn Chin.
