Arkansas Board of Pharmacy Disciplinary Action in February 2013 Minutes--No Apparent Discipline Regarding Compounding


PROBATION CONSENT ORDERS
Dr. Kirtley presented the Board with a Probation Consent Order for Janet R. Fisher,
#PD07210. By signing the Probation Consent Order, Respondent Fisher agrees to
comply with the stipulations of this Order.
Dr. Kirtley presented the Board with a Probation Consent Order for Casey M.
Stephenson, #PD10152. By signing the Probation Consent Order, Respondent
Stephenson agrees to comply with the stipulations of this Order.
BOARD ACTION:
Dr. Bryant made the motion to accept the Probation Consent Orders for the
pharmacists mentioned above. Dr. O’Neal seconded the motion. The vote for
the motion was unanimous.

CONSENT AGREEMENTS
Dr. Kirtley presented the Board with a Consent Agreement for Altamease Phillips,
PD#11846. By signing the Consent Agreement, Respondent Phillips has agreed to pay
a civil penalty of five hundred dollars ($500) to the Board within 30 days of approval by
the Board.
Dr. Kirtley presented the Board with a Consent Agreement for Custom Pharmacy
Solutions, #OS02251. By signing the Consent Agreement, Respondent Custom
Pharmacy Solutions has agreed to pay a civil penalty of one thousand dollars ($1,000)
to the Board within 30 days of the acceptance of this Order by the Board.
Dr. Kirtley presented the Board with a Consent Agreement for Harris Hospital,
#HP01080. By signing the Consent Agreement, Respondent Harris Hospital has
agreed to be placed on probation for one year from the effective date of this Agreement
and pay a monetary penalty of two thousand five hundred dollars ($2,500) to the Board
within 30 days of approval by the Board.
BOARD ACTION:
Dr. Newsome made the motion to accept the Consent Agreements for each
licensee. Dr. Bryant seconded the motion. The vote for the motion was
unanimous.
AGREED ORDERS
Dr. Kirtley presented the Board with an Agreed Temporary Order for Nancy Jo
Loveless, #PT93652. By signing the Agreed Temporary Order, Respondent Loveless
has agreed to not practice as a pharmacy technician and shall not be physically present
in a prescription department in any pharmacy in the state of Arkansas until order by the
Board.
Dr. Kirtley presented the Board with an Agreed Temporary Order for Roderick Britton,
#PT97024. By signing the Agreed Temporary Order, Respondent Britton has agreed to
not practice as a pharmacy technician and shall not be physically present in a
prescription department in any pharmacy in the state of Arkansas until order by the
Board.
BOARD ACTION:
Dr. Bryant made the motion to accept the Agreed Temporary Orders for each
licensee. Dr. Newsome seconded the motion. The vote for the motion was
unanimous.

VOLUNTARY SURRENDERS
Dr. Kirtley presented the Board with Voluntary Surrenders for the following licensees:

 Tiffany McGinnis, #PT93335
BOARD ACTION:
Dr. Boyd made the motion to accept the Voluntary Surrenders for the licensees.

Arkansas Board of Pharmacy Believes Their Regulations Regarding Compounding Are Among Most Comprehensive Compared to Other State Boards of Pharmacy Regulations


Dr. Kirtley presented the board with an update and review of complaints regarding
compounding pharmacies. Eddie Glover, Kristin Riddle and Rebecca Mitchell of US
Compounding; DJ Jackson and Chris Hutts of Cantrell Drug and Andrew Mize of Collier
Compounding appeared before the Board to join in the discussion. All parties agreed
that the Arkansas State Board of Pharmacy regulations regarding compounding are
among the most comprehensive compared to other state Boards of Pharmacy
regulations and are appropriate to protect the health and safety of the public.
Dr. Kirtley presented the Board with a letter from Ther-Rx requesting that the Board
notify pharmacists in Arkansas of the recent statements by FDA regarding compounding
of hydroxyprogesterone caproate injection (17P)

Arkansas Board of Pharmacy's Statement on Compounding Issues


Compounding Pharmacy Issues
Most everyone has heard of the recent tragedy surrounding the
inappropriate compounding of products that has affected so many
people around the nation with fungal meningitis. In the aftermath of
this tragedy, the Board has seen numerous responses and emergency
changes to pharmacy rules around the nation. In Massachusetts, the
home state of the pharmacy with the tainted products, one of the
state’s immediate responses was to order its board to conduct regular,
unannounced inspections. The Arkansas Board is proud to say that it
has done regular inspections of its pharmacies for years and it makes
every effort to inspect each one at least once annually. The Board’s
review of the 2012 inspections shows that 667 of the 748 pharmacies
in Arkansas were inspected between January 1 and December 7. This
number does not include additional site visits for changes of location,
new openings, or the multiple visits and walk-throughs the Board does
routinely for its major compounding pharmacies. It is also important to
note that all of the Board’s pharmacy inspectors as well as executive
and assistant directors are licensed pharmacists with experience and
expertise in various areas of pharmacy practice. Board staff has sought
out and received training in regard to United States Pharmacopeia
standards such as Chapter 797 and has incorporated sterile compounding
inspection surveys into the Board’s workflow for any pharmacies
that are preparing sterile products. While the Board does not claim this
to be an absolute safety net, the Board continues to pursue additional
opportunities for training and learning opportunities to continually
improve its efforts in inspecting compounding pharmacies.

Arkansas Veterinary Medical Examining Board Practice Act Relating to Prescription Drugs


ARKANSAS VETERINARY MEDICAL EXAMINING BOARD PRACTICE ACT
§17-101-305(a)(14) deals with the discipline of veterinarians in Arkansas who use, prescribe or sale veterinary prescription drugs without a valid veterinarian-client-patient relationship. That section provides as follows:


 VETERINARIANS - DENIAL, SUSPENSION OR REVOCATION OF LICENSE
(a) Upon written complaint by any person or on the Board‟s own motion and after notice and hearing as prescribed in the Administrative Procedure Act (25-15-201 et. Seq.), the Board may deny, suspend for a definite period or revoke the license of any veterinarian and/or impose a civil penalty for:

(14) The use, prescription or sale of any veterinary prescription drug, or the prescription of an extra-label use of any over-the-counter drug in the absence of a valid veterinarian-client-patient relationship;

Arkansas Pharmacy Association Meeting Tonight, August 28, 2012

2012 APA District Meeting
 
Meeting begins at 7pm with a business meeting.  Attendees will receive reports from the Arkansas Pharmacists Association, the Arkansas State Board of Pharmacy, the UAMS College of Pharmacy, and the Harding College of Pharmacy.
 
The CE for the evening will be a "Pharmacy Open Door Forum" where audience members are able to interact with the leaders of pharmacy in Arkansas to get answers to the issues currently facing the profession.
 
The APA District Meetings are approved for 2.5 hours of continuing education by the Arkansas State Board of Pharmacy.
