This case is brought by the Office of Attorney General at the request of the Commissioner of Health for violations of the Texas Food, Drug, and Cosmetic Act (the “Act”), Chapter 431 of the Texas Health and Safety Code.1 Appellants/Defendants are as follows: Medical Discount Pharmacy, L. P. (“Medical Discount Pharmacy”) is a licensed wholesale distributor of prescription drugs.2 Lifechek Rosenberg GP, Inc. (“Lifechek Rosenberg”) is the general partner of Medical Discount Pharmacy, L.P.3 Lifechek, Inc. (“Lifechek”) is a Texas corporation owned and controlled by Defendant Gingrich.4 Bruce Gingrich (“Gingrich”) is the owner of Medical Discount Pharmacy, Lifechek Rosenberg, and Lifechek, Inc. as well as the owner of the 20-plus Lifechek pharmacies located throughout the State of Texas.

On July 6, 2010, FDA agents arrived at the Medical Discount Pharmacy office in Rosenberg, Texas, and confiscated 170 units of the stolen Advair (matched by the lot numbers) and receipts for two cashier’s checks, one for $15,600 to Alex Oria from Bruce Gingrich. Several weeks later, the Department inspectors inspected the Medical Discount Pharmacy offices and confiscated 8 more units of the stolen Advair. Part of the docket found here:
