Texas State Board of Pharmacy Takes Up Physician Dispensing Issue


On Tuesday, August 5, the Texas State Board of Pharmacy (TSBP) met to discuss a number of pending issues and to propose or adopt proposed rules. Additionally, the agenda included a number of reports as well as recent discussions between the agency and the stakeholders.

The key issue on the agenda was a report regarding the pharmacy stakeholder meeting to discuss the possibility of a new class of pharmacy to be located in a physician’s office allowing limited dispensing privileges. Allergan representative Bob Broadus, R.Ph., a supporter of the concept, again testified before the TSBP requesting that agency staff begin drafting proposed rules.

TPA’s President-Elect Designate Rene Garza, Pharm.D. and PharmPAC Chair Christopher Alvarado, Pharm.D. also testified during the TSBP meeting and expressed opposition to both the creation of this new pharmacy category and to providing limited authority for physicians to dispense cosmetic or aesthetic pharmaceuticals. After lengthy discussions among Board members, the agency’s Board voted in a six to four decision to direct staff to begin drafting proposed rule. One reason for the TSBP action was to allow continued conversations on this issue to take place and to provide TSBP, members of the public and stakeholders to debate the specific language.

The TSBP is expected to see a draft of the proposed rules during its November meeting. TPA will keep you apprised.
