Job Description:
Attorney IV Performs highly complex (senior-level) attorney work. Work involves planning and organizing legal activities, interpreting laws and regulations, preparing legal documents, rendering legal advice and counsel, consulting with trial attorneys, preparing for hearings, conducting hearings, and assisting in preparing cases for trial. Represents Health and Human Services Commission (HHSC) through its Office of Inspector General (oig), Chief Counsel Division, in administrative enforcement case hearings. May train others. Works under the direct supervision of the Director of Sanctions, and under the general supervision of the Chief Counsel, with considerable latitude for the use of initiative and independent judgment.
Essential Job Functions:
Conducts and assists in conducting contested case hearings, before the HHSC Appeals Division and the State Office of Administrative Hearings, under chapter 2001 of the Government Code in pursuit of enforcement actions taken under title 1 chapter 371 of the Texas Administrative Code. (20%) Pursues administrative enforcement in cases assigned, including processing and resolving Texas Medicaid claims for overpayment, administrative penalties, and other administrative actions, including exclusion from participation in Texas Medicaid and other federally funded health care programs. Determines legal sufficiency of HHSC-OIG Medicaid Provider Integrity (MPI) investigations and other cases referred. Prepares administrative enforcement cases for trial, and represents the agency in matters before an Administrative Law Judge as appropriate. Negotiates and handles settlement of administrative enforcement cases in accordance with settlement terms approved by management. Drafts advisory and recommendation memoranda for Sanctions Section and/or Chief Counsel Division management approval in creating case strategies, and implements case strategies approved by management. Trains and assists other agency counsel and Sanctions Specialists. (60%) Determines eligibility to enroll as a Texas Medicaid provider based on criminal history and related background check results, and handles informal adminstrative reviews of adverse enrollment decisions. (10%) May draft memoranda on regulatory matters or administrative rules for the Texas Register. May research, draft, or assist in drafting bills and amendments for legislative consideration. May serve as a liaison with complainants to be represented in an administrative hearing or with their authorized representatives. (10%) Attends work on a regular and predictable schedule in accordance with agency leave policy and performs other duties, which may be altered at management discretion, as assigned.
Knowledge Skills Abilities:
Knowledge of legal principles, practices, and proceedings; knowledge of laws, regulations, and rules related to the agency. Strong skill in legal research, writing, and analysis. Ability to conduct hearings, to prepare opinions and briefs, to prepare cases for trial, to conduct research, to summarize findings, to interpret and apply laws, to use legal reference materials, to communicate effectively, and to train others. Knowledge of ethical principles governing the practice of law. Experience in legal work, preferably related to administrative enforcement of state agency rules, policies, and related authorities in health and human services programs.
Registration or Licensure Requirements:
Member in good standing with the State Bar of Texas.
Initial Selection Criteria:
Graduation from an accredited law school with a Bachelor of Laws (LL.B.) or a Juris Doctor (J.D.) degree. Member in good standing with the State Bar of Texas. At least five years full-time experience as a licensed attorney.
