20th Question of the Day July 8, 2014 Just because a compounding pharmacy treats a sales or marketing representative as a 1099 rather than a W-2 employee doesn't mean it is so? Why are so many compounding pharmacies forcing sales and marketing representatives to go or be 1099? Limiting their liability maybe? Makes it easier to cut the 1099 person lose? Makes it easier to throw the blame and liability for certain issues at the 1099 sales or marketing representative. And again there are all those legal and tax issues related to 1099 (independent contractor) vs. w-2 (agent/ employees). Each sales or marketing representative would be wise to counsel their own legal counsel regarding issues and questions in this area. This can be a very dangerous and gray area.
