Question of the Day December 4, 2013 A recent article questions the FDA's use of enforcement discretion. Isn't enforcement discretion much like prosecutorial discretion? There are a lot of factors, much thought, and a lot of behind the scenes overtime work that goes into making these decisions on behalf of the United States. Isn't it much easier to critize the decisions than to try and understand them?
