Federal judges have issued a stay of execution for Missouri inmate Allen Nicklasson. The state had planned to execute Nicklasson on Wednesday.
The order followed the inmate's claim of ineffective counsel. The state has appealed that stay, and is expected to appeal any other stays that may arise.
On Tuesday afternoon, the 8th Circuit refused to consider lifting the stay issued on Monday. The state is now looking to the Supreme Court, which is expected to make a decision Wednesday. Missouri's execution warrant is valid from 12:01 Wednesday morning to 11:59 that evening.
