In light of the joint motion to dismiss the appeal in the 11th Circuit Court of Appeal in U.S. v. Franck's, it is interesting to remember the article written by Carlos E. Medina and published on September 2, 2012. Click here to read that story. Do any readers know if Franck's new business is still in operation? While it is true the new business does not deal with veterinary compounds, isn't is also true that pharmacy law is pharmacy law for the most part and what applies to the human compounding world applies to the animal compounding world? Franck's sold the veterinary compounding business and that part of the business is still in operation--just by a different owner and under a new name. This former appellate lawyer is still pondering whether the issues in this appeal are truly moot. Any thoughts from readers on the mootness issue?
