More lawsuits filed against pharmacy in fungal meningitis outbreak


Two new federal lawsuits, one in Michigan and the other in Minnesota, have been filed against the Massachusetts pharmaceutical firm being blamed for a widespread fungal meningitis outbreak.
In a class action suit filed in Michigan in behalf of Brenda Bansale, New England Compounding Center is charged with negligence and violation of state consumer protection statutes.
According to the 27-page complaint, Bansale was injected with a steroid from New England Compounding Center on Aug. 28 at Michigan Pain Specialists in Brighton, Mich. On Oct. 4, she developed severe headaches and nausea and was hospitalized for treatment of a fungal infection.
The class action was filed on behalf of all Michigan residents who were treated with the tainted back pain steroid.
A second lawsuit against New England Compounding Center was filed in Minnesota on behalf of Rosalinda Edwards, a Shakopee, Minn., resident, who was injected with the steroid at a pain clinic in Edina, Minn., on Aug. 1. According to the complaint, she was informed on Oct. 7 that her injection was from a lot of the tainted steroids.
She subsequently underwent a lumbar puncture to test for meningitis and other testing but was released from the hospital.
The first Tennessee suit was filed yesterday in Davidson County.
